INSTRUCTIONS FOR COMPLETING THE VA CONTRACT

 

If you do not submit the offer correctly, it WILL be rejected...the asset manager cannot counter offer if there are any errors.

The VA will accept or reject offers...no counteroffers will be given - this is a government requirement. If you get a rejection, please communicate to the buyer that we encourage them to re submit until we reach the point that I can accept their offer.

Suggestion:  If you got the form via email or electronically, when printing, change the paper size to LEGAL.  This helps enormously when faxing to help ensure legible copies.

·        General info - Do NOT under any circumstances use "white out" on your contract to make changes. This is not a legal method of execution. Start over with a fresh document or if you attempt to mark out and change, be sure it is legible and buyer initials all changes. If the asset manager cannot read it, it will be rejected.

·        VA Lead Paint disclosure must be included if property was built prior to 1978. Do not send any other Lead Paint disclosure form - must be VA form 26-6705e

·        Offers must be on VA contract form 26-6705. It is a TWO page document! Please be sure you, the co broker, and the buyer review the second page.  Please have the buyer sign and date the 2nd page.   Do not send any other contract. No VA addenda forms are required (unless you are in Virginia).

·        Please do not fill in the "property identifier" number on top right, the listing agent will do that once they get your offer.

·        All of the blanks must be filled in. 

·        Complete ONLY the left side of the offer terms. The section you need to complete is labeled as "cash offer", number 7.  The other side of the form is for vendee financing use only and this method of financing is not currently available from VA.

·        Discount Points and Loan Origination (lines 7 b-c) - I advise that you NOT use these lines. If the buyer is requesting seller contribution to these costs, please put dollar amount in the Closing Costs line 7d instead. This will give the buyer much greater flexibility in how the funds are used.

·        Closing costs (line 7d). NO closing costs will be paid by seller... none... not at all... unless you fill it in on lines 7d. Closing funds contributed by seller can NEVER be used for title insurance. Seller also does not allow a general closing credit (i.e. credit for carpet).

·        Calculate and fill in commission dollar amount (full 6% but no more...see sales bonus explanation in next item if you have a low priced asset)

·        Calculate and fill in the sales bonus amount if applicable (refer to listing agmt)

·        Check the calculations for total deductions and net to VA - if the math is wrong, offer gets rejected because if offer has an error, the asset manager cannot counteroffer.

·        Days to close must be provided in the offer - offer will be rejected if left blank. We cannot currently close anything in less than 15 days. You must fill a number of days...please do not put a specific date.

·        Earnest money of $1000.00 must be filled in. No promissory notes for earnest money deposit.  A copy of the check must accompany offer.

·        Remember, when requesting closing cost contribution from seller, it will impact your net and offers are evaluated on net to VA.

·        NO contingencies are allowed by VA except for financing as outlined in item 6 on page 2 of the Contract. To further clarify: No inspection contingency can be accepted. Earnest money will NOT be returned as a result of buyer's inspection or any other contingency per VA. This is a change from the way it has been previously handled.

·        Please include a verification of cash funds if you are submitting a cash offer.

·        Please include a pre qualification letter if it is a financed offer.

The turn around time for an answer on your offer generally runs any where from 1-3 business days with additional days required due to a high volume of offers.
